Here are the terms and conditions for any digital application or podcast platform (the "Application") presenting audio and associated metadata produced and owned by This American Life PBC (the 'Company') - including but not limited to the podcast This American Life (the 'Content').
POINT TO OUR FILES AND DATA
The Application must point directly to the Content as linked to and contained within our RSS feeds, and must not copy audio files to be hosted or served by other servers. Without separate written permission, the Application may not pull or display any data or content apart from that included in the RSS feeds - for example, the Application may not present images from our website, alternate logos, or program or episode descriptions written by a third party.
The Application must not present any advertising, sponsorship or promotional messages in or around the Content, including but not limited to audio, video, display or text advertising. The Application may not present the inclusion of the Content in any proposal to advertisers. For clarity: if a user takes an action to listen to an episode on the Application, no advertising of any kind may be triggered to occur before, during or after playback.
NO MARKETING USAGE
Without explicit written permission, logos or show names from the Content may not be used in marketing materials for the Application, including but not limited to promotional web pages, social media, newsletters, paid advertising, app store listings or screenshots. The exceptions are that the logos and show names may be included in presentation of the Content itself, and within in-app lists, groupings and search results.
OWNERSHIP OF CONTENT
The Company owns the Content, and is licensed to exploit all intellectual property rights therein. Therefore the Application's presentation of the Content will not infringe upon the rights of any third party, nor require any clearance or payment by owners of the Application of any kind or nature, including, but not limited to, any payment to any record label, music publisher, or performance rights collection body.
RESTRICTIONS ON USAGE
The Content may not be altered in any way within the Application.
NO CONTENT-SPECIFIC APPLICATIONS
Applications must not solely present the Content, but rather must present it within a broader array of audio programs. For example, an Application or website devoted solely to presenting This American Life is in violation of these terms.
REQUEST FOR REMOVAL
At the Company's sole discretion, the Company reserves the right to require that the Content be removed from any Application and to revoke the Application's right to link to the Content, at any time upon notice to you, even if the above guidelines are followed, including, for example, if inclusion on the Application would violate the terms of another agreement into which we are entered.
